The following describes our procedures and outlines remedies in the case of problems. The text on this page may be changed at any time and should be checked before placing and order. If you have any concerns about our policies, please contact us.
Any hosting plan payable on a monthly basis may be canceled at any time. No refund will be issued for such cancellation unless it is canceled within the first month (30 day period) of creating the hosting account. In that case, a full refund will be issued as long as there are not any outstanding balances due for that account, such as site work we were hired to do but were not paid for. Non-monthly hosting plans can also be cancelled at any time. However, a refund may not be issued, or if it is issued, a penalty may apply. When cancelling a hosting account, you must notify us via email of your intention to do so and we must reply to that email confirming the cancellation. Failure to do this may result in the account not being terminated and any charges will continue to be due.
Standard hosting plan payments are due on the 28th of each month. If the balance is not paid when due, a reminder will be sent out. If payment is still not made, the account will be suspended. If the account remains unpaid when the next payment is due, a notice will be sent out explaining that the full amount is due. If it is not paid, the account will be closed and all files erased. After the files and erased, we may not be able to restore them. However, if they are to be restored by us, there will be a charge for this service. For resellers and dedicated plans, the accounts will be closed after one month.
Templates may be purchased for use on another host. The prices for our templates are shown on the oscommerce template category. If you open a new, yearly, hosting account with us, the chosen template and its installation is completely free! In either case, the template cannot be returned or exchanged.
Quotes are provided on an individual basis and may vary from person to person, or even job to job. When an initial quote is provided, it will be done via email. Once the quote is accepted, it will be posted on our site in the form of a link. Only the site owners and the person the quote is for may view this quote. After a quote has been listed, you may visit the page and review it. If all is as agreed upon, click on the Add to Cart button and complete the order process. All quotes are for the price stated, except in cases where partial payment is being made. This will be stated on the quotes page.
You may ask for, and receive in most cases, a refund after an order has been made as long as no work as been started by us. Once we have begun the requested work, any refund will be pro rated based on our time spent to that point.
Completion of Work
After the work has been completed, you will be shown a test site on which the changes may be viewed, if requested and the order is large enough to warrant it, as determined by us. If the changes are as agreed, the remaining amount, if any, will be due. After the final payment is made, the changes will be installed on your server, or provided to you in a zip file, per your preference. If payment is not made or payment is revoked, changes made may be removed.
Warranty Period and Upgrades
We will provide updates free of charge for any installation done by us if a new version of the installed addon(s) is released within 30 days of the installation, or 60 days if the addon(s) is one of ours. We will also fix problems related to the changes we made within those same periods. If a problem is discovered, or if an update is released, after those periods, there may be a charge for the fix or update. We would determine that on a per order basis.
Should the event arise in which you do not agree with the work that was done, we will make every effort to reach an amicable solution. Just provide us with the reason for our failure to complete the work to your satisfaction. Our goal is to make our customers happy with their sites. We realize that our business relies to a great extent on word-of-mouth and we will do all that we can to ensure you are happy with the work you asked us to perform. In the event that a solution can not be reached and payment is not paid, you agree that any changes made to your shop by us may be removed and your site restored to its original condition.
Liability and Warranty
We are not responsible for any damages your business may suffer. We do not make implied or written warranties for any of our services. We deny any warranty or merchantability for a specific purpose. This includes loss of data resulting from delays, non-deliveries, wrong delivery, and any and all service interruptions caused by us. The client acknowledges that the service provided is of such a nature that service can be interrupted for many reasons other than the negligence of the company and that damages resulting from any interruption of service are difficult to ascertain. Therefore, client agrees that the company shall not be liable for any damages arising from such causes beyond the direct and exclusive control of the company. You further acknowledge that the company's liability for its own negligence may not in any event exceed an amount equivalent to charges payable by the client for services during the period damages occurred. In no event shall the company be liable for any special or consequential damages, loss or injury.
